By which meanes the s.d Mathew Ward gained y.e Posession from y.e
s.d W.m Smith by A writt being served upon y.e s.d Smith: From the
Provintiall Courtt without further [illegible] And having the posession
of the s.d Land & Premises afores.d That then y.e s.d Mathew Ward
entred upon y.e s.d Land and Premises: And being in Posetion as
afores.d Att y.e s.d Plantation to farme upon his own Acromp.t to his
own Proper use and behalfe to one John Stark: and one Edward Renolds
for the sume of two thousand Pounds of tobacco & Caske
as by the oaths of y.e s.d Stark and Renolds Doth appear by w.ch meanes
y.e Land is yett unsold: Yett notwithstanding y.e s.d James Ringgold doth
hereby signifie and Declare that he hath often times Demanded the
s.d Papers and Premises by the s.d Ward That then the s.d James Ringgold
by his Attorny Rob.t Carvill Procured the s.d Mathew Ward to Come
before y.e Hon.rbl Calvertt y.e Chancelo.r of Maryland and there the s.d
Ringgold y.e Letters of Attorny left to him y.e s.d Ringgold and Henry
Hosier by Rob.t Burgis touching the Premises & the s.d Ward
haveing made his Defence y.e Chancelor gave his opinion that y.e
Papers & Premises ought to be Delivered to the s.d Attorny by y.e
s.d Ward he being no other Concerned: but for the Recovery of y.e
Posession from smith as Attorny at Law: Yett notwithstanding
since y.e Arivall of M.r Winslow: before severall persons: he y.e s.d
Ward: still Refused to Deliver y.e s.d Papers: Pretending fayned
& idle Excuses: so that the s.d Ward so: Mischevious: In the p.rmises
We Dare not sell nor Promise sale of the s.d Land it being Contrary
to the statute Law which for y.e Better satisfaction herein nor
have thought fitt to Incourtt to yo.u the Woords as followeth: Nor
Person or Persons shall bargain Buy or sell or by any meanes
obtaine gett or Covinant to have any Right or title of any
person in or to Any Manors Teniments or other heridetiments
But if such Person or Persons shall so Bargain give grant
Covinant or promise the same their Anchestors They by whome
he or they Claime the same or if Reformatin or Remander there
of or taken the Rent or Proffits thereof: by the space of one whole
yeare next before y.e s.d bargaine Covinant grant or promise made
upon paine: that he that shall make any such bargaine sale promise
grant or Covinant shall forfitt the whole vallew of the Land Teniments
hiredetiments so bargained sould and promised Covinanted or
granted Contrary to this act and the buyer or taker thereof:
