86 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1807.

Mr. Ray, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petitions of Rebecca English and Mary Watkins, of Montgomery
county, praying to be supported as out-pensioners, beg leave to report, that the prayer of the petitioners ought
not to be granted, and that they have leave to withdraw their petitions.

By order, D. L. JACOB, clk.
Which was read the first and second time by especial order and concurred with.

Mr. Steuart, from the committee, delivers to the speaker a bill, entitled. An act to lay out and open a road
from Bond-street, on Fell's Point, to intersect the York turnpike road; which was read the first time and order-
ed to lie on the table.

On the second reading of the bill for the benefit of Daniel Forney, of Baltimore county, the question Was
put, That the whole of the said bill after the words "Be it enacted, by the General Assembly of Maryland, "
be stricken out? Resolved in the affirmative.

The question was then put, That the following be inserted in lieu thereof? viz. " That the sheriff of Baltimore
county shall summon twelve freeholders, disinterested persons, residents of said county, and they, of a majority of
them, are hereby authorised and required to value and ascertain the damages, taking into consideration the ad-
vantages and disadvantages, if any, which the said Daniel Forney may have sustained by reason of the said road
being laid out through his land, and to return a certificate thereof, under their hands, to the clerk of Baltimore
county court, and the said damages, when so valued and ascertained, shall, within thirty days thereafter, be
paid by the president and directors of the said company to the said Daniel Forney, or his order. " Resolved in
the affirmative.

The question was then put, That the following be inserted after said amendment? " And be it enacted, That
when the sheriff shall have summoned the persons aforesaid, before they shall proceed to value and ascertain the
damages, they shall take the following oath, or affirmation, as the case may be i " I, A. B. do swear, or affirm,
"that I will, without partiality, value the damages sustained by Daniel Forney on account of the Baltimore and
" Reister's-town turnpike road passing through his lands, to the best of my judgment; so help me God. " Re-
solved in the affirmative.

The question was then put, Shall the said bill pass? Determined in the negative.

On motion, Leave given to bring in a bill, entitled, An act authorising a lottery to raise a sum of money to
purchase a fire engine, and finish the church in Westminster-town, in Frederick county. ORDERED, That Mr,
Shriver, Mr. Biggs and Mr. Kuhn, be a committee to prepare and bring in the same.

ORDERED, That the report of the committee relative to the penitentiary have a second reading on Thursday
next.

ORDERED, That the bill to increase the allowance of the justices of the orphans courts in the several counties
of this state, have a second reading on to-morrow.

On motion, Leave given to bring in a bill, entitled, An act to authorise a lottery in Elkton, iin Caecil county,
to raise a sum of money to finish the Elkton academy, to purchase philosophical apparatus for the same, and to
pave and improve the streets of Elkton. ORDERED, That Mr. Mitchell, Mr. Cox, Mr. T. Moffit, Mr. Porter
and Mr. Stone, be a committee to prepare and bring in the same.

The bill to lay out and make public an old road in Harford county, was read the second time, passed, and sent
to the senate by the clerk.

The following order was read.

ORDERED, That no new business be introduced into this house after - next

The following leave was read.

Leave to bring in a bill authorising and empowering the drawing of a lottery in this state for the purpose of
establishing county and parish schools in this state for the education of poor children, and for other purposes.

On motion, Leave given to bring in a bill, entitled, A further supplement to the act, entitled, An act for the
relief of Sundry insolvent debtors. ORDERED, That Mr. Kerr, Mr. Stone, Mr. Mitchell, Mr. Winder and Mr.
Stevens, be a committee to prepare and bring in the same.

Mr. Little, from the committee, delivers to the speaker a bill, entitled, An act for the opening of Bridge-
street in the precincts of the city of Baltimore; and Mr. Streett, from the committee, delivers to the speaker a

bill, entitled, An act to lay out, straighten and amend, an old road in Harford county, from, the Maryland line
to Isaac Davis's; which were read the first time and ordered to lie on the table.

Mr. Holbrook, from the committee, delivers to the speaker a bill, entitled, A further supplement to the act,
entitled, An act for the regulation and improvement of Denton, in Caroline county; which was read the first
time and ordered to lie on the table.

A petition from William M'Donald, in behalf of the proprietors of the French-town and New-Castle line of
water and land stages between Baltimore and Philadelphia, praying that ho other line of stages may be autho-
rised to use a road laid out by them without reimbursing a proportion of the expense incurred by said proprietors,
was preferred, read, and referred to Mr. Mitchell, Mr. Porter and Mr. Cox, to consider and report thereon.

A petition from Bennet Hamilton and Charles Sewell, of Charles county, praying they may be indulged in the

payment of a balance due the state, was preferred, read, and deferred to Mr. Green, Mr. Rogerson and Mr.
Stone, to consider and report thereon.
