So it was determined in the negative.
Mr. Levin Winder, a delegate returned for Somerset county, appeared, and after qualifying in the mode pre-
scribed by the constitution and form of government, and taking the oath to support the constitution of the
United States, took his seat in the house.
ORDERED, That Mr. Bruce, Mr. Bowles and Mr. Tomlinson, be a committee to inquire into the expediency
of granting a sum of money for the purpose of opening and improving that part of the road lying between the
point of termination of the Baltimore turnpike road, in Washington county, and the commencement of the great
Western road, at Cumberland.
The clerk of the senate delivers a bill, entitled, A further supplement to the act, entitled, An act to incorporate
companies to make several turnpike roads through Baltimore county, and for other purposes, endorsed, " will pass, "
which was read the first time and ordered to lie on the table. And the further supplement to the act, entitled,
An act for appointing a wreckmaster in Worcester county, endorsed, " will pass. " Ordered to be engrossed.
The resolution in favour of Richard Choate, was read the second time by especial order, and assented to.
On motion, the question was put, That the house reconsider the, report on the petition of Julia Cook?
Resolved in the affirmative. ORDERED, That said report be recommitted..
On motion, the question was put, That the house dispense with the seventeenth rule thereof? Resolved in
the affirmative.
ORDERED, That Mr. Winder, and Mr. Gale, of Somerset, be added to the committee to bring in a bill to re-
gulate and discipline the militia of this state.
On motion, Leave given to bring in a bill, entitled, An act to extend further the powers of the levy court of
Allegany county, relative to roads in said county, and for other purposes. ORDERED, That Mr. Bruce, Mr.
Briscoe and Mr. Greenwell, be a committee to prepare and bring in the same.

THE house met. Present the same members as on yesterday, except Mr. Ayres. The proceedings of yes-
terday were read. Mr. Ayres and Mr. Davis appeared in the house. Mr. John Williams, a delegate returned
for Worcester county, Mr. John J. Cox, a delegate returned for Caecil county, and Mr. Thomas Blakistone, a dele-
gate returned for Saint-Mary's county, appeared, and after qualifying in the mode prescribed by the constituti-
on and form of government, and taking the oath to support the constitution of the United States, took their
seats in the house.
The resolution in favour of Richard Choate was gene to the serrate by the clerk..
A petition from Frances M'Elvain, of Montgomery county, praying that the title to property conveyed by
her to Henry Hawkins Young may be confirmed to him, was preferred, read, and referred to Mr. Carroll, Mr.
Darne and Mr. Ray, to consider and report thereon.
A petition from William Evans, of the city of Baltimore, praying a divorce, was preferred, read, and re-
ferred to Mr. Steuart, Mr. Blakistone and Mr. Harryman, to consider and report thereon.
Mr. T. Dorsey, from the committee, delivers to the speaker a bill, entitled, An act for the sale of the real
estate of James Winchester, late of Baltimore county, deceased; which was read the first time and ordered to
lie on the table.
A petition from John Dashiell, of Worcester county, stating that there is an error in the date of a deed from
Isaac Dixon to him, and praying relief, was preferred, read and referred, to Mr. J. E. Spencer, Mr. Robins and
Mr. Sudler, to consider and report thereon.
A petition from Catharine Johnson, of Charles county, stating that she is unable to support her afflicted
daughter, and praying some relief, was preferred, read, and referred to Mr. Stone, Mr. Rogerson and Mr.
Green, to consider and report thereon.
Mr. Steuart, from the committee, delivers to the speaker the following reports:
THE committee to whom was referred the petition of John Barnhart and Sarah Barnhart, of the city, of Balti-
more, praying a divorce, report, that they have taken the same into their serious consideration, and are of opinion
that the prayer of the said petitioners ought not to be granted, and that they have leave to withdraw their petition
