36 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1805.

receipt of Edward Lloyd Wailes, the then sheriff of Prince-George's county, heretofore exhibited to this house,
that the securities paid poundage fees to the amount of one hundred and forty pounds fourteen shillings and
seven-pence more than what was due to the state, which sum, your committee find, was not credited in the
settlement made by the chancellor.

Your committee are of opinion, that as the securities of Thomas Williams paid the sum of one hundred and
forty pounds fourteen shillings and seven-pence, poundage fees, in consequence of the fieri facias being issued
for a greater sum than what was actually due to the state, and the same not being credited in the settlement
made by the chancellor, the said securities ought to be reimbursed the sum of one hundred and forty pounds
fourteen shillings and seven pence, with interest thereon from the day of payment thereof to the sheriff, and
therefore submit the following resolution:

RESOLVED, That the treasurer of the western shore pay to Rinaldo Johnson and Elisha Berry, securities of
Thomas Williams, the sum of one hundred and forty pounds fourteen shillings and seven-pence, with interest
thereon from the eleventh day of June, seventeen hundred and ninety-two, the same being for poundage fees
paid by them to the sheriff of Prince-George's county on a fieri facias issued by the state of Maryland, return-
able to October term, seventeen hundred ninety, it appearing by the settlement made by the chancellor,
under a resolution of the general assembly, that the fieri facias was issued against them for a much greater sum
than was due to the state, in consequence of which the securities paid the sum of one hundred and forty pounds
fourteen shillings and seven-pence more than was due on the debt actually owing from them to the state.

All which is submitted.

On motion, Leave given to bring in a bill to prevent persons retailing spirituous liquors near the religious
places of worship of the people called Methodists, in Anne-Arundel county, and for other purposes. ORDERED,
That Mr. Merriken, Mr. Watts and Mr. Ward, be a committee to prepare and bring in the same.

On motion, the question was put, That the bill, entitled, An act to provide for the election of the governor
by the people, and to abolish all those parts of the constitution and form of government which relate to the
council to the governor, and the time and manner of electing the governor, and for other purposes, be referred
to the first day of June next ? The yeas and nays being required, appeared as follow:

So it was determined in the negative.

The question was then put, Shall the said bill be made the order of the day for Thursday next ? Resolved in

the affirmative.

Mr. Sudler, from the committee, delivers to the speaker a bill, entitled, An act to continue the act therein
mentioned; which was read the first time and ordered to lie on the table.

Mr. Ayres, from the committee, delivers to the speaker a bill, entitled, An act to lay out and open a road
in Harford county; which was read the first time and ordered to lie on the table.

A petition from Josiah W. Heath, and others, praying that a road may be opened through the lands of Sarah
Polk, of Somerset county, was preferred, read, and referred to Mr. Cottman, Mr. Bayly and Mr. Jackson, to
consider and report thereon.

A petition from Sarah and Whittington Polk, counter to the petition of Josiah W. Heath, and others, was
preferred, read, and referred to the committee appointed on the petition to which it is counter.

On motion, ORDERED, That the bill, entitled, An act concerning estates tail, be made the order of the day
for Friday next.

The bill to lay out and open a road in Harford county, was read the second time and passed.

Mr. Ellicott, from the committee, delivers to the speaker a bill, entitled, An act to streighten the road lead-
ing into Howard-street in the city of Baltimore; which was read the first time and ordered to lie on the table.

The bill, entitled, An act granting additional compensation to the harbour-master of the port of Baltimore,
was read the second time and passed.

A petition from Patrick Murdock, of Allegany county, stating, that there was a deficiency in sundry lots
held by him in Allegany county, and praying some compensation tor the same, was preferred, read, and re-
ferred to Mr. Bruce, Mr. Tomlinson and Mr. Rizer, to consider and report thereon.

The clerk of the senate delivers the resolution relative to the investment in the Farmers Bank, endorsed
" assented to. " Also the bill authorising James Hackett, and others, securities of James R. Pratt, late sheriff,
and John B. Hackett and Richard E. Harrison, late collectors, of Queen-Anne's county, to complete the collec-
tion of the money due the said sheriff and collectors, and the bill to enable James Walker, John Sprigg Belt
