So it was determined in the negative.
Which bill was sent to the senate by the clerk.

The clerk of the senate delivers the following message:

BY THE SENATE, January 2d, 1806.
GENTLEMEN OF THE HOUSE OF DELEGATES,

THE gentlemen appointed to count the ballots for a person to be recommended to the governor to be commis-
sioned as register of wills for Saint-Mary's county, having reported that the ballot boxes were found, on exa-
mination, to contain more ballots than there were attending members of both houses when the boxes were
sealed. We propose, with your concurrence, to proceed immediately to ballot again for a person to be recom-
mended as register of wills for Saint-Mary's county, and have named the gentlemen mentioned in our former
message on this subject to join those who may be nominated by you, to count the ballots. No person is added
to the former nomination.

THE house met.

The clerk of the senate delivers the engrossed bill No. 116, with the paper bill thereof, endorsed, " read
and assented to; " which was read and assented to, and sent to the senate by the clerk.

The amendment proposed to the bill to confirm certain acts of magistrates who hold, or have held, offices
under the general government, was read the second time, agreed to, and the bill ordered to be engrossed.

The amendment proposed to the bill for the benefit of the corporation of the Roman catholic clergymen, and
for other purposes, was read the second time, agreed to, and the bill ordered to be engrossed.

On motion, That the further consideration of the bill to open, improve and turnpike, the road from Willi-
am's Port, in Washington county, to Cumberland, in Allegany county, be referred to the next general assem-
bly ? The question was put, That the house adjourn until to-morrow morning 9 o'clock ? Resolved in the affir-
mative.

The house adjourns until to-morrow morning 9 o'clock.

TUESDAY, January 28, 1806.

THE house met. Present the same members as on yesterday. The proceedings of yesterday were read.
The engrossed bills Nos. 100, 108, 111, 112, 113 and 115, were read and assented to, and, with the paper
bills thereof, sent to the senate by the clerk.

The following message being read and agreed to, was sent to the senate by the clerk.

BY THE HOUSE OF DELEGATES, January 28, 1806.
GENTLEMEN OF THE SENATE,

WE have received your message, relative to the going into a new ballot for a register of wills for Saint-Ma-
ry's county, on account of a mistake in ballotting; we propose going into the ballot immediately; there is no
other person put in nomination than those whose names were mentioned in the former message.

By order, J. BREWER, clk.

The clerk of the senate delivers the engrossed bills Nos. 100, 108, 111, 112, 113 and 115, with the paper bills
thereof, severally endorsed, " read and assented to. "

The following resolution was read the first and second time by especial order, assented to, and sent to the
senate by the clerk.

RESOLVED, That the treasurer of the western shore pay to Thomas Bayly, Esquire, one of the delegates
from Somerset, county, or to his order, seven dollars, for two days attendance, and to John Cottman, Esquire,

delegate from the same county, twenty-one dollars, for six days attendance, which sums have been omitted to
be allowed them on the journal of accounts.

The house proceeded to ballot for a person to be recommended to the governor to be commissioned as regis-
ter of wills for Saint-Mary's county; the ballots being deposited in the ballot box, the gentlemen named to
strike retired, and after sometime returned and reported, that James Forrest had a majority of votes. Where-
upon

RESOLVED, That James Forrest be and he is hereby recommended to the governor to be commissioned as re-
gister of wills for Saint-Mary's county.
