124 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1805.

The house proceeded to the second reading of the report of the committee on the petition of Samuel Chase;
on motion, the question was put, That the further consideration of the same be referred to the next general
assembly? The yeas and nays being required, appeared as follow:

Hebb, Dorsey, Chapman, Bayly, Ward, Muir, Bishop, Selby,

Leigh, Stuart, Denny, Hyland, Hall, Sudler, Ellicott, Bruce. 35.

NEGATIVE.

So it was resolved in the affirmative.

The engrossed bills Nos. 110, 114, 117, 118 and 119, were read and assented to, and, with the paper bills
thereof, sent to the senate by the clerk.

On motion, ORDERED, That the supplement to the act, entitled, An act relating to negroes, and to repeal
the acts of assembly therein mentioned, and the bill to open, improve and turnpike, the road leading from Wil-
liam's Port, in Washington county, to Cumberland, in Allegany county, be referred to the consideration of the
next general assembly.

The amendments proposed to the further additional supplement to the act, entitled, An act to direct descents,
were read the second time, agreed to, and the bill ordered to be engrossed.

The clerk of the senate delivers the engrossed bills Nos. 110, 114, 117, 118 and 119, with the paper bills
thereof, severally endorsed, " read and assented to. "

The following resolution was read the -first and second time by especial order, assented to, and sent to the
Senate by the clerk.

RESOLVED, That the treasurer of the eastern shore pay to the examiner of the said shore the sum of one hun-
dred and thirty-three pounds seven shillings and ten-pence three farthings, to complete his salary lor the year
eighteen hundred and five.

The clerk of the senate delivers the resolutions relative to certain bills of exchange, the resolutions in fa-
vour of Martha Raisin and Henry Gassaway, and the resolution relative to Saint-John's and Washington col-
leges, severally endorsed, " dissented from. " And the resolution in favour of Thomas Bayly and John Cott-
man, endorsed, " assented to. " Also a letter from the executive, enclosing resolutions of the legislature of Geor-
gia, requesting an amendment proposed by the state of North-Carolina to the constitution of the United
States. And the following messages:

BY THE SENATE, January 28, 1806.

GENTLEMEN OF THE HOUSE OF DELEGATES,

WE have declined a reconsideration of the bill, entitled, An act appropriating a sum of money for the erec-
tion of a penitentiary, but if you will originate a resolution in your house, directing the treasurer of the western
shore, to pay to the commissioners, or a majority of them, mentioned in the resolution passed the Last session,
the money by that resolution appropriated, it will receive the concurrence of this house.

BY THE SENATE, January 28, 1806.
GENTLEMEN OF THE HOUSE OF DELEGATES,

WE have declined reconsidering the resolution in favour of Henry Gassaway, as it was before rejected upon
mature consideration.

Which were read.

The following resolution was read the first and second time by especial order, assented to, and sent to the
senate by the clerk.

Whereas by a resolution of the last session of the legislature, the sum of twenty thousand dollars was ap-
propriated out of the fines, forfeitures, amerciaments and licences, arising within the city and county of Bal-
timore, which, in the opinion of the treasurer, could not be drawn out of the treasury by reason of the de-
fective and inexplicit provisions of the said resolutions; therefore, RESOLVED, That the treasurer of the
western shore pay to John Eager Howard, Thomas Dixon, Josias Pennington, Thomas M'Elderry, Robert C.
Love, Levi Hollingsworth, Daniel Conn, Samuel Sterrett and George Warner, commissioners appointed to su-
perintend the erection of a penitentiary, or to their order, or the order of a majority of them, the sum of
twenty thousand dollars, to be applied to that object, as the same shall come into the treasury from the fines,

forfeitures, licences and amerciaments, arising within the city and county of Baltimore.

Mr. Montgomery, from the committee, delivers to the speaker the following report:
