347 That Case made and provided and against the peace of the said Lords Propry his good rule and Dignity &c wherefore the afd Attorney prayeth the advice of the Court here in the premisses for the said Lord Propry and due process of Law against the afd Jane in this part to issue to Answer to the said Lord Propry of and upon the premisses &c T francis Clk pacis A Noli prosequi being provided from his Excellency the Governour the Court thereupon orders all proceedings here on to Cease and the Noli prosequi to be Entered which is as follows viz.t To the Worshipfull Justices of Kent County Whereas I am informed by Coll.o S.t Leger Codd of your County that he is apprehensive there may be a prosecution against him in your County Court for Incontinantly Living with a Certain Jane Kennard and whereas I am given to understand that the prosecution is Contrived and Carryed on by a troublesom Woman more out of prejudice and Malice to him then any regard to the Law, and altho the said persons may be able to acquitt themselves of the accusation yet there will be a Charge. I do therefore here by order you that Imediatly upon a Return of a presentment or Information or any other means of prosecution for that fact against the bovesaid persons or either of them that you Stop any further proceedings therein and Enter a Noli prosequi thereon for all which this shall be your Warrant given under my hand and Seall this 14.th day of November 1727 Ben.dt Leon.d Calvert Also it is Considered on the Day & year afd that the said Jane Kennard pay the sum of one hundred Seventy Eight pounds of Tobacco Costs accruing on the psses afd Jam.s Smith Clk
