The parish and County afd) the sixth day of March Anno Domm
Seventeen hundred twenty and six at the parish afd in the County
afd within the Jurisdiction of this Court having been duly admonished
by the Vestrymen of the same parish in the afd County did afterward
to wit the first day of July Anno Dom seventeen hundred twenty and
seven and at divers other times as well before as since the afd sixth
day of March at the parish afd in the County afd within the said
Jurisdiction adulterously frequent the Company of a Certain Jane
Kennard the same Jane then and yet being the wife of a Certain
Nathaniel Kennard of the same parish and County contrary to the
Act of Assembly in that Case made and provided and against the
peace of the said Lord Prop.ry his good rule and Dignity wherefore
the afd Attry prayeth the advise of the Court here in the premisses
for the said Lord Prop.ry and due process of Law against the afd
S.t Leadger Codd in this part to issue to answer to the afd Lord
Prop.ry of and upon the Premisses &c.a
                                                                T francis Cler. pac.

    The afd S.t Leger Codd producing a Noli prosequi from his Excell.cy
whereupon the Court orders all proceedings to Cease and the Noli
prosequi to be Entered which is as follows viz.t

            To the Worshipfull Justices of Kent County

    Whereas I am Informed by Coll S.t Leger Codd of y.e County that
he is apprehensive there may be a prosicution against him in
your County Court for incontinantly Living with a Certain
Jane Kennard and whereas I am given to understand that the
prosecution is Contrived and Carryed on by a troublesom woman
more out of prejudice and Malice to him then any regard to
the Law, and altho the said Persons may be able to acquitt themselves
of the Accusation, yet there will be a Charge I do therefore hereby
order you that Imediatly upon Return of a presentment or
Information or any other means of prosecution for that fact
against the above said persons or either of them that you stop
any further proseedings therein and Enter a Noli prosiqui thereon
for all which this shall be your Warrant Given under my
