3 form of the act of assembly in that Case made and provided M. Howard Cler. pac. Underneath the preceeding Indictment was written as foll viz.t Billa Vera Josias Lanham foreman. Afterwards to wit the Seventeenth Day March Anno Domini one thousand Seven hundred and twenty three Cometh hereinto Court the afd Michael Howard to maintain the Charge laid in the Indictment afd against the afd William Burk Confesseth herein Court that he will not prosecute the same Indictm.t any farther against the said William Burk Therefore it is Considered by the Justices here to wit at the Courthouse in the Town of Chester in Kent Coty afd the Seventeenth Day of March Anno Dom. one thousand Seven hundred and twenty three that the afd William Burk as to the Indictment afd go thereof without Day and be there from acquitted also it is Considered that the s.d William pay the sume of twelve hundred & Seventy one pounds of Tobacco Costs accruing on the premises afd to the officers of this Court Jam.s Smith Clk. The afd William Burk haveing Enter'd into Recognizance at last Court for appearance to this Court to answer the Indictment afd. Ordered that the Same Recognizance & Suretys be Discharged William Burk of Kent County Labourer at last Court did acknowledge himselfe indebted unto the right Honourable the Lord prop.ry of this province his heires and Successors in the sume of twenty pound sterl to be made and Levy'd of his goods and Chattels Lands and Tenements Conditionally that if the same W.m Burk should not make his personal appearance at the then next County Court to beheld for said County to answer unto the Indictm.t afd. and now at the said next Court to wit at the Court house in the Town of Chester this Seventeenth Day of March Anno Domini one thousand Seven hundred & twenty three the afd William Burk appears and there upon his recognizance is Discharged also Gideon Pearce Gentl. and John Clark planter both of Kent County at last Court did acknowledge themselves indebted unto the right honourable the Lord. Prop.ry of this Province his heires and Successors in the Sume of tenn pound Sterl each to be made and Leveyed of their goods and Chattels Lands and Tenements Conditionally that if y.e afd William Burk Should not make his |
