281 peace of y.e s.d Lord prop.ry that now is his good Rule and Government and against the form of the Act of Assembly in Such Case lately made & provided Test Mary Sheppard T francis Cler. pac. On the Back of y.e preceeding Indictment was as foll.s viz.t True Bill Sam.l Groome forem.n And the afd Tench Francis Attorney of y.e s.d Lord prop.ry Cometh and Saith that for as much as y.e Evidence to y.e Indictment afd being a Convict Sent over from England he will not prosecute the Same Indictment any further Therefore it is Considered by the Justices here to wit at y.e Court house in y.e Town of Chester in s.d County this 20.th Day of June Anno Dom. 1727 that the afd Abel Jones as to y.e s.d Indictment he go thereof without Day and be therefrom Acquitted also it is Considered that y.e s.d Abel Jones pay the Sume of two hundred and fifty ^one^ Costs Accrueing on y.e premisses afd to y.e officers of this Court Jam.s Smith Clk
Parish in Kent County aforesaid labourer the first Day of March Anno Domini Seventeen hundred and Twenty at the parish aforesaid in the County aforesaid within the Jurisdiction of this Court with force and arms &c.a the Close of a Certain Gervis Spencer did break and Enter and a Spade Mare of a Dark brown Colour of the price of One thousand pounds of Tobacco of the goods and Chattles of the afd Gervis Spencer then and there to wit at the Parish aforesaid in the Coty aforesaid with in the Jurisdiction aforesaid being found then and there feloniously did Steal take and lead away against the Act of Assembly in such Case made and provided and against the peace of the said Lord proprietary that now is his good rule and Dignity M Howard Cler. pac. Testes W.m Comegys Andrew Clements Gervis Spencer On the Back of y.e preceeding Indictment was as foll.s viz.t A True Bill John Taylor foreman And the afd Thomas Jones in his proper person Comes and Saith that he is in no Sort Guilty of the premisses above upon him Imposed as by the afd Indictment it is alledged and of this he puts himself upon the Country Tho.s Jones And he who follows for the Lord prop.ry in like manner Saith his is Guilty T francis p Lopp Thereupon Command was given to the Sher of Kent County that he |
