Prosecuteth doth Come here into Kent County Court before Lambert Wilmer Esq.r
and his Associates his said Lordships Justices of the same County Court to wit
at Chester in the afd County the Seventeenth Day of November Anno Dom. seventeen
hundred twenty and Six and for the same Lord prop.ry doth give the Court here
to understand and be informed that John Henry late of Saint pauls parish
in the County afd Higgler the fifteenth Day of November Anno Dom. seventeen
hundred twenty and Six at Saint pauls parish afd in the County afd within
the Jurisdiction of this Court of a Certain John Evans of Kent County afd
Gentleman the same John Evans One of the Right Honourable the Lord
Proprietary his Justices of the peace for the County afd and in the Execution
of his Office out of Court then being openly publickly and Malliciously in
the presence and hearing of many of the good people of this province these
Scandalus and Malicious English Words following did speak assert and
with a Loud voice pronounce and publick I (he the said John Henry
meaning / value no Irish Justice in Maryland (he the afd John Evans
meaning / and lett him (he the afd John Evans again meaning / putt me
(him the afd John Henry meaning) in the Stocks if he (the afd John Evans
again Meaning / dares To the great Contempt and lessening the Authority
of the afd John Evans in the Execution of his Office afd to the Evill Example
of all others in such Case Offending against the peace of the said Lord
prop.ry that now is his good rule and Dignity and against the form of the
Act of Assembly in such Case lately made and provided &c.a Wherefore
the afd Attorney prayeth the Advice of the Court here in the premisses
for the said Lord prop.ry and due process of Law against the afd John
in this part to issue to Answer unto the said Lord Prop.ry of and upon
the premisses

    And the afd John Henry in his proper person comes and saith that he
Cannott gainsay the Information afd so as afd against him brought nor
but that he is guilty of the premisses above upon him imposed as by the
afd Information it is alledged and thereupon Submitts to the Court
Therefore it is Considered by the Justices here to wit at the Court house
