229 afd in Kent County afd within the Jurisdiction of this Court did Committ fornication with a Certain person tot he Jurors afd unknown and did permitt the same unknown person then and there have Carnall knowledge of her body and to begett then and there a bastard Child on the body of her the same Elizabeth To the high Displeasure of Almighty God to the Evill Example of all others in such Case offending contrary to the peace of the said Lord prop.ry his good rule and Government and against the of Assembly in that Case made and provided Test Griffith Jones T francis Cler. pac. On the back of the preceeding Ind.t was as foll viz: a true bill by Sam.l Wickes foreman And the afd Elizabeth Clark in her proper person Comes and saith that she Cannott gainsay the Indictment afd so as afd against her brought nor but that she is guilty of the premisses above upon her Imposed as by the afd Indictment it is alledged and there upon Submitts to the Court Therefore it is Considered by the Justices here this fifteenth Day of Nov.r Anno Dom. seventeen hundred twenty & six that the afd Elizabeth Clark pay the sum of thirty Shillings Current Money of Maryland as a ffine for her afd Crime of Committing ffornication in form afd Confest to be applyed for the use of this County according to Act of Assembly &c.a As also the sum of four hundred and Seven pounds of Tobacco Costs accrueing on the premisses afd to the Officers of this Court Jam.s Smith Clk The afd Elizabeth being ordered to prove the begitter of her Child declares on her Oath adminestred to her on the Holy Evangilists ^of Almighty God^ that Jacob Vanbeber of Ceecill County is the ffather of her last base born Child which she was delivered off Christopher Bateman Jun.r and Nehemiah Powell both of Kent County planters and present here in Court in their proper persons under take and either of them undertakes Joyntly and Severally for the afd Eliz.a Clark that she the said Elizabeth shall keep this County of Kent clear from all Damages or Costs that may hereafter accrue on Acco.t of the afd Child in the Indictm.t afd Specefyed John Gresham of Kent County Gentl and present here in Court in his pper person assumes to pay all the ffees in the Judgment afd Specefyed amounting to four hundred and seven pounds of Tobacco and thereupon the said Elizabeth Clarke is therefrom acquitted |
