181 of the Tobacco that was packed in the outward parts of the s.d hoggshead was good Sound and Merchantable and the afd Tench Francis Doth give the Court here further to understand and be informed that the s.d John Nanscoyne afterward to wit the afd tenth Day of May Anno Dom. Seventeen hundred twenty and Six at the parish afd in the County afd within the Jurisdiction of this Court the afd hoggs head of Tob.o being so fallaciously & Deceitfully as afd packed Did tender and pay away unto William Pearce of y.e afd County planter for the use of Edward Sanders without Declareing y.e Nature and Quality of the Tobacco in the said hoggs head Contained against the peace of the s.d Lord prop.ry that now is his Good Rule and Dignity and ag.st the form of the Act of Assembly in that Case lately made and provided &c.a wherefore the Same Attry of the said Lord prop.ry for the Same Lord prop.ry prayeth the advice of the Court here in the premisses and Due process of Law in this part to be made against the afd John Nanscoyne to answer unto the afd Lord prop.ry of and upon the premisses &c.a T francis Test W.m Pearce Geo. Linneger. John Gerry. Abra.m Drew John Griffin And the afd John Nanscoyne in his proper person Comes and Saith that he is in no Sort Guilty of the premisses above upon him Imposed as by the afd Information it is alledged and thereupon he putteth himself upon the Country Jn.o Nanscoyne in p.a psona And he who followeth for the Lord prop.ry in like manner Saith he is Guilty T francis p Lord prop.ry And now here afterwards to wit the twenty Second Day of June Anno Dom. 1726 Comes here into Court the afd John Nanscoyne and Relinquishes his place afd & saith that he Cannot Gainsay the Information afd So as afd ag.st him brought nor Can he Say but that he is Guilty of the premisses above upon him Imposed as by the afd Information it is alledged and thereupon Submitts to the Court Therefore it is Considered by the Justices here this twenty Second Day of June Anno Dom. Seventeen hundred and twenty Six that the afd John Nanscoyne pay the Sume of one thousand pounds of Tobacco as a fine for his afd Crime of false packing Tob.o according to Act of Assembly in that Case made and provided one half whereof to his Lordship his heirs and Successor for the use of this County y.e other brought to Cap.t Edward Sanders as Informer for his Lopp ag.st the s.d John also it is Considered that the s.d John pay the Sume of three hundred and Seventy four pounds of Tobacco Costs Accrueing on y.e premisses afd to y.e officers of this Court Jam.s Smith Clk ordered |
