parish afd in the County afd within the Jurisdiction of this Court in and upon a Certain John Stephens in the peace of God and of the s.d Lord prop.ry then and there being with force and Arms an Assault Did make and him the said John Stephens then and there did beat wound and Evilly treat that of his Life it was much Dispa^i^red and other harms to him then and there Did to the Great Damage of the said John Stephens and against the peace of the s.d Lord prop.ry that now is his Good Rule and Government &c.a T Francis Cler. pac. Test. John Stephens W.m Comegys On the Back of y.e lack of y.e preedng Indictment was Endorst as foll.s viz.t A true bill by W.m Crowe foreman of y.e Grand Jury And the afd Patrick Fitzgerald in his proper person Comes & that he Cannot gainsay the Indictment afd so as afd against him brought nor but that he is guilty of the premisses above upon him Imposed as by the afd Indictm.t it is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit at the Court house in the Town of Chester in s.d County this Eighteenth Day of November Anno Dom. Seventeen hundred and twenty five that the afd Patrick Fitzgerald pay the Sume of two hundred and fifty pounds of Tobacco as a fine for his Assaulting the afd John Stephens as also that he pay the Sume of one hundred accrueing on the premisses afd to y.e officers of this Court Jam.s Smith Clk M.r William Comegys and M.r Abraham Redgrave two of the Justices of this Court Returns a Recognizance Dated September 17.th Anno Dom. 1725 against the afd Patrick Fitzgerald to Answer unto Such matters as shall be objected ag.st him and now at this Court the s.d Patrick appears and ordered His Recognizance be Discharged Patrick Fitzgerald of Kent County planter at the Day and year afd before the afd William Comegys and Abraham Redgrave Acknowledged himself Indebted unto the Lord prop.ry of this province in the Sume of ten pounds Sterl to be Leveyed &c.a Conditionally that if he Should not make his personal appearance before the Justices of this Court to Answer unto what Should be objected against him for Assaulting a Certain John Stephens and if |
