ceiving from the commissioners an account on oath of the

Sec. 3. And be it enacted, That the commissioners, or a
majority of them, shall value and ascertain the damages
that may be sustained by any person or persons, through

into consideration the advantages and disadvantages, if
any, and the damages so ascertained shall be levied and
assessed as other county charges in said counties are, and
shall be paid by the county, wherein such damages may be

before some justice of the peace, that they will, without

Coutt of Equity, to decree and order tlie sale of certain
real estate.

Section 1. Be it enacted by tlie General Assembly of
Maryland, That the Frederick County Court, sitting as a
Court of Equity, are hereby authorised and empowered to

late of said county, deceased, under the proceedings al-
ready filed in said court, in number twelve hundred and

Provided, said court are satisfied it will be for the benefit

and advantages of all the parties concerned; And provided,
