Passed Mar 14, 1833

An act to lay out and open a Road in Montgomery, Anne
Arundel, and Baltimore Counties.

Commissioners to

lay out and open

Section 1. Be it enacted by the General Assembly of
Maryland, That Col. Lyde Griffith and William Etcheson,
of Montgomery county; Henry Wayman and Greenbury
Warfield, of Anne Arundel county, and Vachel Brown
and Wilton Burditt, of Baltimore county, be, and the same

full power and authority, in their own discretion Survey,

Location prescrib-
ed

lay out, and open a road, not exceeding thirty feet in width,
commencing on the old Quaker load, at the farm of the
late Ephram Etchison, in Montgomery county, from thence
running to, and crossing the Patuxent river, at the junc-
tion of Ignatius Warthing's spring branch, thence to the
Lutheran church, thence to Parrsville, on the Frederick and
Baltimore turnpike road, and from thence to a public road
leading to the Baltimore and Ohio Rail-road Depot, all of
which said road shall be located on the best and most prac-
ticable route, and the said commissioners shall make out a
plot of that part of the road through Montgomery county,
and return the same to the clerk of the county court, to be
recorded among the records of said county; they shall like-

wise make out a plot of that part of the road through
Anne Arundel county, to be recorded among the records
of said county; and they shall also make out a plot of that
part of the road through Baltimore county, to be recorded
among the rpcords of said county, and the said road,
when so opened, shall be thereafter deemed to be a public

ner, as other public roads are directed to be kept up, in
said counties.

Appointment

of expenses.

Sec. 2. And be it enacted, That the expenses of sur-
veying and opening the said road, shall be paid by Mont-
gomery, Anne Arundel, and Baltimore counties, in propor-
tion to the distance it may pass through each county, and

the levy court of Montgomery county, the commissioners
of Anne Arundel county, and the commissioners of Balti-
more county, are hereby authorised and required, on re-
