An act to lay out and open a Road in Montgomery county.
|

Section 1. Be it enacted by the General Assembly of
Maryland, That Evan Thompson, Darius Darby, and Otho
Magruder, of Montgomery county, be and the same are
|

lay out and open.
|
|
|
hereby appointed commissioners to survey, lay out, and
open a road not exceeding thirty feet in width, commenc-
ing at Damascus in said county, and to intersect, by the
most direct and practicable route, the old road at or near
Aden Darby's house, and from thence to the county road,
in the best and most direct route, leading from Seneca
bridge to Rockville, on the west side of Otho Magruder's
farm; and the said commissioners shall make out a plat of
said road, and return the same to the clerk of Montgomery

county, to be recorded among the records of said county,
and the said road, when so opened, shall thereafter be
deemed to be a public road forever; and shall be kept in
repair in the same manner as other public roads are direct-
ed to be kept in said county.

Sec. 2. And be it enacted, That the expenses of sur-
veying and opening said road shall be paid by said county,
and the levy court are hereby authorised and required, on
receiving from the commissioners an account, on oath, of
the said expenses, including an allowance of two dollars
per day to the commissioners for their services, to levy the
same on the assessable property in said county, to be col-
lected as other county charges are now collected.

Sec. 3. And be it enacted, That the commissioners, or
a majority of them, shall value and ascertain the damages
that may be sustained by any person or persons, through
whose land the said road may be made to pass, taking into
consideration the advantages and disadvantages, if any;
and the damages so ascertained shall be levied and assess-
ed as other county charges are, and paid over to the per-
son or persons so ascertained to have sustained damages.
