1832.

the commencement of the actual construction of the said
road from Baltimore to the city of Washington, be ex-
tended to twelve months from the passage of this act, and
the said road shall be completed in the manner provided

CHAP. 175.

for in the eight section of the said supplement within
three years after the commencement of the actual construc-
tion thereof, and shall be completed with two sets of tracks
fit for use by .travel and tranaportation within five years

Term prescribed.

Sec. 13. And be it enacted, That if the owner of any
land which may be condemned for the bed of the Balti-
more and Washington Rail Road shall be aggrieved by the
decision of a jury summoned for that purpose, by virtue of
the powers granted in the first section of the act to which
this is a further supplement, it shall be lawful for the party
so. aggrieved to appeal to the County Court of the county
in which any such land shall be; and either party may have
a trial by jury, and in ascertaining the damages of the par-

ty so appealing, regard shall be had, and the damages esti-
mated as well for the injury done by dividing the estate of
said aggrieved party, and all other injuries which he may
sustain by reason of said Rail Road passing through his
estate as for the value of the land so condemned; and it
shall be the duty of the court to which any such appeal
may be taken to hear and determine the same at the first
term of said court thereafter; unless good and sufficient
cause to the contrary be shewn.

mated.

Sec. 14. And be it enacted, That it shall be lawful at any
time for the State to construct or to charter a company to
construct a Rail Road from the city of Annapolis, or from
any other part of the State, to intersect the road herein
intended to be constructed at such point on said road as
the Legislature may see fit, and that the State or such

company, when chartered, shall have power and authority
to establish a depot at the intersection of said roads.

Depots.

Sec. 15. And be it enacted, That all such parts of the
original act, and the supplement thereto, as are at all in-
consistent with the provisions of this act, be and the same
are hereby repealed.

Repealing clauses

Sec. 16. And be it enacted, That the owners of the Sa-
vage Factory and of the Factory called Johnson's Factory,
and of any other Factory which is or shall be established
within fives miles of the said Rail Road authorised by this
act, shall respectively be entitled to connect a road from
their several Factories to and with said road, and to
erect a depot at the point of junction; and it shall be the
