dicai Haines' Mill, where the Road which passes the black-
smith shop now owned by John Smith, but formerly known
as Haines' blacksmith shop, in that direction, now strikes
said public Road, and running thence in a South-Easterly
direction, to the Easterly end of the Lane, which passes the
dwelling of David Cassell, and which terminates at the dis-
tance of little more than a quarter of a mile from said Cas-
sell's house; occupying the identical tract which the Road
now connecting those points occupies; thence in as direct a
line as the Commissioners appointed to locate said Road,
may deem most proper, to the lime-kiln owned by Jacob
Grove, and located upon the farm which said Grove now
occupies; thence, in like manner, to the Westerly end of the
Lane, dividing in part the farms of Col. Gist and Basil D.
Stevenson; thence upon the tract which said Lane now oc-
cupies, to the Easterly end thereof; thence to such point
upon the great Road leading from Westminster to Wash-
ington, as the Commissioners as aforesaid, may deem most

proper it should strike; which point shall be the termination
of said road; and the said commissioners shall make out a plat
of that part of the Road through Frederick county, and re-
turn the same to the Clerk of the county court, to be recor-
ded among the records of said county; they shall likewise
make out a plat of that part of the Road through Baltimore
county, to be recorded among the records of said county;
and the said Road, when so opened, shall be thereafter

deemed to be a public Road forever; and shall be kept in
repair in the same manner as other public Roads are di-
rected to be kept up in said counties.

Sec. 2. And be it enacted, That the expenses of survey-
ing and opening the said Road shall be paid by Frederick
and Baltimore counties, in proportion to the distance it
may pass through each county, and the Levy Court of Fre-
derick county, and the Commissioners of Baltimore county,
are hereby authorized and required, on receiving from the
Commissioners, an account, on oath, of the said expenses,

including an allowance of two dollars per day, to the Com-
missioners, for their services, to levy the same in the pro-
portion before stated, on the assessable property in said
counties, to be collected as other county charges are now
collected.

Compensation

Sec. 3. And be it enacted, That the Commissioners, or
a majority of them, shall value and ascertain the damages,
that may be sustained by any person or persons, through
whose land the said Road may be made to pass; taking into
consideration the advantages and disadvantages, if any, and
