In case of the misapplication of any

of the funds under this act, by the

vidually responsible, and shall refund

to the State,

purchase out the whole estate at par,

with interest,

Further stipulations, required of the

company before any payment under

this act, relative to the rate of tolls,

and that said rates shall not be changed

without consent of the State,

And that they will report quarterly
to the treasurer under oath, until their

works be completed, statements of the

work done, and to be done, &c.

So soon as sufficient sinking fund is

provided to pay the principal and in-
terest, &c. or become forfeit, &c. the

surplus shall be applied to the support
ef common schools throughout the

State, and distributed according to the

ratio prescribed in resolution No. 47,

of 1833,
