SEC 3. And be it enacted, That when any section or

portion of the said roads shall be put out on contract, the
person contracting therefor, shall file, with the clerk of the

levy court of said county, a written contract or instrument
of writing, designating the part or Section of said road
contracted for, and the terms of said contract, and each and
every of said contractors shall be subject to the same penal-
ties, fines, and forfeitures, for neglect of duty, to which
overseers of the public roads in said county are subject
under the existing laws
