JAMES THOMAS, ESQUIRE, GOVERNOR.

1834.

Sec. 2 And be it enacted, That the capital stock of the
Delaware and Maryland Rail Road Company, shall not ex-
ce d four hundred thousand dollars, divided rnto eight
thousand shares of fifty dollars each, and as soon as four

thousand shares of the said stock shall be subscribed, in
the manner provided by the preceding section, the subscnb
ers to the saipp, and their successors shall enjoy all the
rights and privileges conferred by the act to which this is a
supplement, and they shall thereupon proceed to organize
and elect their officers in the manner therein prescribed

Sec 3 And be it enacted, That the toll on any species
of merchandise, or property on the said Rail Road, shall
not exceed eight cents per ton, per mile, and on passengers,
shall not exceed four cent per mile

Sec. 4 And be it enacted, That the said company are
hereby authonsed to purchase, hold, and enjoy such real
estate as may be necessary and proper, for promoting the
objects of said company whenever they may elect all need-
ful buildings, wharves, warehouses, and other edifices, re-
quisite for the business of the said Company and also that

the said company shall have power to establish a line or
lines of steam boats between Philadelphia and Baltimore,
in connection with the said Rail Road, and to purchase
steam boats, and to do all other matters and things acces
sary for that purpose

General powers

Sec 5 And be it enacted, That in addition to the com-
missioners named in the act to which this is a supplement,
the following persons be, and hereby are appointed commis-
sioners, to wit— Matthew Newkirk Aquilla A Brown, and
John Hemphill, of Philadelphia, William C Scott, and
Euward Wilson of Elkton, John N Black and Levi H
Evans, of Charlestown, John J Milligan and Henry Whilely,
of Wilmington, and J I Cohen and Philip Laurenson of
the city of Baltimore

Commissioners

Sec 6 And be it enacted, Tint unless the the said Rail
Road be commenced within two years from the passage of
this art, and finished wrthin six years thereafter, the saic
act, and all the rights and privileges which it confers on
said company, shall cease, and he utterly void

Limitation.

Sec 7 And be it enacted, That the said Rail Road shall
be constructed from some point on the Delaware and Ma-
ryland line, to be by the Presrdent and Directors of said
Company determined, through the town of Elkton, in Cecil
county, to some point on the North East or Susquehanna
