CHAP. 251

drums, files, bugles, and trumpets, by the commissioned of-
ficers of companies, contributing in the proportion of the pay
to which they would be entitled if in actual service, but the
Governor and Council may distribute any drums, files, bu
gles and trumpets, belonging to this State, among the uni
form or draughted militia thereof, when and as they shall
deem expedient, taking receipts from the commanding of
fleers, for those that may be delivered to them, respectively,
in which the signer shall obligate to return he same when
demanded, or pay the value thereof to the State, which
value shall be specified in such receipt

Sec 43 And be it enacted, that if any bystander shall in
terrupt, molest, or insult any officer or soldier, while on duty,
at any time required by this act or by the laws of any compa-
ny, the commanding officer of the company, at the time of
such offence may cause the offender to be confined for the

a company court martial, which court shall proceed on such
trial in like manner as other courts martial, for imposing
