CHAP 251

Sec 46 And be it enacted, That any arsenal which has
heretofore been provided, and is now used by any uniformed
militia corps, may and shall be continued, in the discretion
of said corps, and the expenses when certified to the Go
vernor and Council as reasonable and correct, and by them
approved, shall be a charge on the funds derived from fines,
forfeitures, and penalties, collected from said corps, and
paid over to the treasurer of the Western Shore and shall
be paid therefrom by said Treasurer upon the order of the
Governor and Council, to the paymaster of such corps, or
to his order

Sec 47 And be it enacted, That before any pay master
shall act as such, he shall give bond and security to the
State of Maryland, to the satisfaction of the field officers
of the regiment, extra battalion, or squadron to which he
belongs, in the penal sum of one thousand dollars, condi
tioned that the officers of the regiment, extra battalion, or
squadron, will semi annually submit to the adjutant general
and the field officers of his regiment, battalion, or squadron,
a full and fair statement of his accounts as paymaster, as
aforesaid, and pay over all the balances remaining in his
hands, when demanded, by his successor in office, or by the
persons authorised to claim and receive the same and in all
things faithfully to discharge the duties of his office

Sec 48 And be it enacted, That if any person shall sell
or buy, unless by the authority of the State, any of the arms or
accoutrements belonging to the State, or give or receive the
same, in pledge, barter, or as a gift, knowing the same to
be public property, or shall injure or destroy such arms or
accoutrements, such person shall, for every such offence,
forfeit and pay twenty dollars and if such arms and
accoutrements, shall, by any of the means aforesaid, be
rendered useless or become lost, such person sliall also
forfeit and pay the full value thereof, as fixed by the State
for arms and accoutrements destroyed or lost, and such for
feitures shall be recovered at the instance of any commis-
sioned officer, and be collected and be pa d over by the
sheriff of the proper county, to the Treasurer of the West-
ern Shore

Sec 49 And be it enacted That whenever any of the
public arms or accoutrements shall be formal in the posses-
sion of any person except ab authorised by this act, or any
law of this State, the same may be demanded by any com
