the adjutant general's office, to be filed therein; and at every
parade or meeting of each company for inspection, the

number and condition of the arms and accoutrements in-
cpected, and those possessed by absent members within the

noted; and the said officers shall cause the same to be en-
tered in the company book aforesaid, discriminating such
as belong to the State from such as belong to individuals,
within three days after such inspection; and shall also,
within ten days thereafter, transmit, by mail, a copy of such

entry, to the adjutant general's office, to be recorded
therein.

Sec. 40. And be it enacted, That all uniform companies
and corps that may be hereafter formed, and those which
now exist, and may retain their organization, shall adopt
the uniform hereby established; the first when they form,
and the latter at the expiration of four years from the pas-
sage of this act; and if any officer shall neglect or refuse to
uniform himself, agreeably to the provisions of this act, he

shall he cashiered or fined, for the first offence, not exceed-
ing fifty dollars, in the discretion of such court martial as
the case may require, and a further sum of fifty dollars for
the like neglect, for every parade succeeding the decision
of the court martial imposing said fine; and the command-
ing officer of any such company shall forthwith erase the

name of each member thereof, who shall neglect or refuse
to adopt or provide himself with, and appear in the uniform
of his company, as required by this act, and the company
by-laws consistent herewith, for two succeeding parades;
and he shall then forthwith hand over the names of such
delinquents to the commanding officer of the company dis-
trict militia, or to serve in the draughted company, in which
he should serve, if he should be a volunteer, under a pe-
naby of twenty dollars for each and every neglect of said
officer, to be imposed on him by such court martial as the
case may require, and collected and paid over by the proper
sheriff, as other fines are directed to be, by this act; and

that it shall be the duty of every commissioned officer to
arm himself as shall be prescribed by the commander in
chief of the militia of this State.

Sec. 41. And be it enacted, That each extra battalion or
squadron, shall have the same staff officers appointed,
commissioned, and attached thereto, as are attached to a
regiment.
