CHAP 106

CHAPTER 105.

Passed Feb. 17 1835

An act to extend to Executors and Administrators the privi-
lege of appeal from judgments rendered by Justices of the
Peace, against their testators or intestates

Right of appeal

Section 1 Be it enacted by the General Assembly of Mary-
land, That from and after the passage of this act, the pri-
vilege of appeal from any judgment, rendered by any jus-
tice of the peace, as is now allowed by law to any person
who may think him or herself aggrieved by the judgment
of any justice of the peace, shall be, and the same hereby
is extended to all and every executor or executors, adminis-
trator or administrators, of any deceased defendant, against
whom, in his life time, any judgment or judgments may
have been rendered by any justice of the peace as afore
said.

Method directed

Sec. 2 And be it enacted, That any and every executor
or executors, administrator or administrators, who shall
apply for an appeal as aforesaid, shall produce to the jus-
tice of the peace, authorised and required to grant the ap
peal as aforesaid, satisfactory evidence of his or her being
executor or executrix, administrator or administratrix, and
the said justice shall proceed to take bond and security from
the executor or executrix, administrator or administratrix
as aforesaid, and to grant the appeal within the same time,
and subject to the same provisions, as are now prescribed
by law, in cases of appeal from judgments of justices of the
peace.

ryland, 1 hat Joshua Guyton, late Sheriff of Harford county,
shall have full power and authority to collect, by execution,
any money due him for fees or for officers fees placed in his
hands for collection whilst he was Sheriff, in the same man
ner that he might have collected the same while he was
