the lottery system of this state, it shall not be necessary to
prove the existence of any game of chance or device, to evade
the said system, or of any lottery, where a name directly or
indirectly appears upon the face of the instrument or device,
sold by the accused; and such name shall not only be conclusive
evidence of the existence of the scheme referred to, but
also that such name is the true and only one.

                                        CHAPTER 189.

An act concerning the Washington and Baltimore Turnpike
                                        Road Company.



Passed Feb. 27, 1830.
    WHEREAS, It has been represented to this General Assembly
of Maryland, that the Rail Road located by the Baltimore
and Ohio Rail Road Company, will cross the road heretofore
made by the President and Managers of the Washington and
Baltimore Turnpike Road Company, on the tenth section of
the said rail road, and near the six mile stone on said turnpike
road; and that it would be for the greater convenience of
both of the said companies, that the location of the said Washington
and Baltimore Turnpike Road should be changed, so
that the rail road may cross it without the necessity of a bridge
or viaduct; Therefore,
Preamble.
    Section 1.  Be it enacted by the General Assembly of Maryland,
That the President and Directors of the said Baltimore
and Ohio Rail Road Company be, and they are hereby authorised
to change the present location of the Washington and
Baltimore Turnpike Road, near the six mile stone of said turnpike
road, to such other and new location as the said President
and Directors may deem best and calculated to facilitate the passage
of said rail road over the said turnpike road.
Change location.
    Sec. 2.  And be it enacted, That the said President and Directors
of the Baltimore and Ohio Rail Road Company be,
and they are hereby further authorised, to obtain possession of
the land included in said new location, with the consent of the
proprietor or proprietors thereof first had and obtained, and to
construct a stone or gravel turnpike thereon, in the same manner
that the said President and Managers of the Washington
and Baltimore Turnpike Road Company might have done, had
such new location been a part of the original location of the
said Washington and Baltimore Turnpike Road; and the said
turnpike road, when so constructed on the new location, to be
made as aforesaid; and when the construction thereof is approved
by the said President and Managers of the Washington
and Baltimore Turnpike Road Company, shall be taken
and used as a part of the said Washington and Baltimore
Turnpike Road; Provided, that the approval of the construction
