CHAP. 56.
|
Sec. 3. And be it enacted,
That it shall be the duty of any
constable in Liberty district, in whose view any offence
against the provisions of this act shall be committed, to give
information thereof, upon oath, before some justice of the
peace for said county, unless the offender pay said fine to the
constable, who is hereby authorised to receive it.

Constables duty.

Sec. 4. And be it enacted,
That it shall be the duty of any
justice of the peace, and any justice is hereby authorised and
required, upon oath made by a constable or other creditable
person, that an offence has been committed, by driving any
team, carriage or other vehicle whatever, or by riding, driving
or leading any horse over the side walks in said village,
or its limits, to issue his warrant against the offender, directed
to some constable of the district, whose duty it shall be to arrest
and carry such offender before some justice of the peace
for said county, to answer said information and complaint,
and any justice, upon proof of the commission of such offence
by such person, shall give judgment for said fine and costs,
upon which judgment there shall be no supersedeas. Justices
of the peace and constables shall be entitled to the same fees
in every respect, as in cases of the recovery of small debts.

Sec. 5. And be it enacted,
That it shall be the duty of the
constable, within thirty days after the collection of any fine
or fines, as aforesaid, to pay over the same unto Abraham
Jones and Thomas Carr, superintendents, elected by the citizens
of Liberty to receive it, and unto their successors as may
be hereafter annually elected by the legal voters of said village
on the first Monday of January in each and every year;
and upon neglect of the constable, or refusal so to do, the
same proceedings shall, in every respect, be had against him
for the recovery thereof, at the suit of said superintendents or
their successors, elected as aforesaid, as above prescribed, for
offenders against this act; and it shall be the duty of the superintendents
to apply the money as above directed, subject
to the same proceedings for neglect or refusal to pay it over
to their successors, as above laid down.

Sec. 6. And be it enacted,
That nothing in this act contained
shall be construed so as to extend to any person or persons
who shall not have had notice of its provisions by a publication
of this act in two of the newspapers printed in Frederick
city, three successive weeks, next after the first day of April
next; nether shall the same be so construed as to render liable
to pay a fine for the violation of its provisions, any person or
persons, their servants or visitors, to pass across said footwalks
in going from or returning to the premises of which he
or she may be in joint or several possession.

That the act entitled, an act to
preserve the [said] walks in the village of Liberty, in Frederick
