CHAP. 21.
|
said clerk of Anne-Arundel county court shall neglect or refuse
to comply with any of the provisions or requisitions of this act,
when called on by the said commissioners, or the clerk
thereof, by their order thereafter, he shall, for every such
neglect or refusal, forfeit and pay to the said commissioners,
for the use of the county, the sum of one hundred dollars,
to be recovered by indictment or action in Anne-Arundel
county court; and the clerk to the commissioners of the tax
shall in like manner be subject to the same penalties for ne-
glect or refusal to deliver over to the clerk of the said com-
missioners all books, papers or documents, which may be-
long or in anywise appertain to the board of commissioners

Sec. 9. And be it enacted, That the said commissioners
shall be entitled to receive two dollars per day each, for
every day they shall necessarily attend to the duties of his
office, and two dollars for every twenty miles he may have
to travel to the place of meeting of the said commissioners.

Suits pending at
time of passage of
the law, &c
|
Sec. 10. And be it enacted, That all suits at law or in
equity which may be pending at the time of the passage of
this act, bv or against the justices of the levy court of said
county, shall be carried on in like manner, and have the
same legal effect, either in favour of or against the commis-
sioners provided for by this act, as if such suit or suits had

been instituted by or against the said commissioners.
Sec. 11. And be it enacted, That so much of any acts of
assembly as may be contrary to, or inconsistent with, this
act, be and the same are hereby repealed.

CHAP. XXII.
An Act for the relief of Thomas Burchenal, of Caro-
line County.
|

Preamble
|
WHEREAS it has been represented to this general assem-
bly, that a certain Henry Camper, was presented by the
grand jury of Caroline county, for manslaughter, and that
he had eluded the two former sheriffs, but was apprehended
by the vigilance of Thomas Burchenal, late sheriff of the
county aforesaid, and was confined in the common gaol of
said county; that from the weakness and insufficiency there-
of, the said Henry Camper escaped from confinement, by
reason whereof the said Thomas Burchenal could not have
him before the court of said county, agreeably to the return,
of the said Thomas Burchenal, and the demands of the said
court, whereupon the said Thomas Burchenal was finally
amerced the sum of twenty-five cents by said court, and
taxed with all the costs arising from the presentment afore-
said; and it not being deemed just that the said Thomas
Burchenal should pay the amount of said. amercement and
