court, in ascertaining the county charges, or for other pur-
poses, and shall receive for such services such fees as he is
now entitled by law to receive; and in case the said clerk
shall refuse or neglect to comply with the provisions of this
act, he shall, for every such refusal or neglect, forfeit and
pay to the said levy court, for the use of said county, one
hundred dollars, to be recovered by indictment or action in
said county.

CHAP. 14.

Sec. 6. And be it enacted, That not less than three mem-
bers of the said court shall form a board for the transaction
of business, a majority of whom may decide upon all mat-
ters coming before them; Provided, that the concurrence
of three of said members shall be required in passing ac-
counts, directing the payment of money, or in making ap
pointments to office.

Sec. 7. And be it enacted, That the said levy court shall
take such appeals as the commissioners of the tax are now
required to take, at any of their meetings between the first
day of April and the last day of May, and for the purpose
of taking such appeals shall meet every day during the
spring term of the county court, and shall give notice in
writing, to be set up in some public place in each election
district, ten days before the commencement of said term, of
the meetings to be held for that purpose.

Sec. 8. And be it enacted, That such of any acts of as-
sembly as may be contrary to, or inconsistent with, the pro-
visions of this act, be and the same are hereby repealed.

CHAP. XV.

An Act relating to the appointment of the Commission-
ers of the Tax for Somerset County.

Passed Feb 2, 1829

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, That it shall be the duty, of the levy court of So-
merset county, at their meeting in April next, and annually
in each succeeding year thereafter, to appoint five sensible,
discreet, and experienced persons of the said county, to be
commissioners of the tax for the said county.

Sec. 2. And be it enacted, That so much of the act of
December session eighteen hundred and twenty-six, chapter
one hundred and seventy-nine, as is repugnant to this act,
be and the same is hereby repealed.
