CHAP. 139.

Diviidends, when

to be declared

Sec. 21. And be it enacted, That the said president and
directors, after the completion of the rail road contemplat-
ed by this act, shall annually or semi-annually, declare and
make such dividend, not exceeding ten per centum per an-
num, as they may deem proper, of the nett profits arising
from said road, after deducting the necessary current anc
probable contingent expenses, and that they shall divide the
same amongst all the stockholders in proportion to their re-
spective shares; and they shall cause a notice of such divi-
dends to be published in one newspaper in Washington,
and in one in the city of Baltimore, and shall annually re-
sort the same to the legislature.

Present turnpike

Sec. 22. And be it enacted, That nothing in this act con-
tained, shall authorise any road company to close the pre-
sent turnpike road, and the same shall be kept to repair by
the company under the penalty now imposed for neglect of
repair of the present turnpike road; the said rail road may
be so constructed as to permit the travelling of private wa-
gons, carriages and horses; for which travelling they shall
receive the same rale of loll now received on the Washing-
ton turnpike road.

Factories autho-

rised to connect a

road with railroad

Sec. 23. And be it enacted, That the owners of the Sa-
vage Factory, and of the Factory called Johnson's Factory,
and of any other Factory which is or shall be established
within two miles of the rail road authorised by this act,
shall respectively be entitled to connect a road from their
several Factories to and with the said rail road, and to trans-
port thereon any produce, merchandise, manufactures, or

other articles whatsoever, bona fide the property of the
owners or occupiers of said factories respectively; Provid-
ed, that the wagons or other vehicles, to be used for such
transportation, shall be such as shall be approved of by the
president and directors aforesaid, or their agent duly autho-
rised for the purpose; and such transportation shall in other
respects conform to such rules as shall be adopted and prac-
tised by the president and directors aforesaid, in relation to
the vehicles used by them upon the said rail road, and sub-
ect to the payment of the tolls which are authorised by the
provisions of this act.

Right to make
a railroad from

served

Sec. 24. And be it enacted, That the state hereby re-
serves the right to charter a company to make a rail road
from the town of Bladensburgh, in Prince-George's county,
to intersect this road, upon the same terms and conditions

Proviso

that are allowed to other persons or companies; Provided,
the road authorised by this act does not pass through the
town of Bladensburgh, leaving to the company hereby in-
corporated, the privilege of extending in lieu thereof a
branch from the main road to the said town.
