on the passage of this act, and in every year thereafter, ap-
point one measurer and inspector of lumber, and a measurer
of coals, for the town of Williams-Port, in Washington
county.

CHAP. 131.

Sec. 2. And be it enacted, That the said inspectors and
measurers, before they shall proceed to act as such, shall
take the following oath, or affirmation, as the case may be,
before some person authorised to administer the same: "I
A. B, do solemnly swear, (or affirm,) that I will faithfully,
truly and impartially, according to the best of my skill and
judgment, execute, do and perform, the office and duty of
an inspector and measurer of lumber, or measurer of coals,
(as the case may be,) for the town of Williams-Port, with-
out favour affection, partiality or prejudice."

To take an oath

Sec. 3. And be it enacted, That the said inspector and
measurer shall each have power to appoint one deputy, who
shall hold his office during the pleasure of the principal in-
spector or measurer, and no longer; and before he acts as
such shall take the same oath, or affirmation, required to
be taken by the second section of this act.

Sec. 4. And be it enacted, That when any person may
want lumber inspected and measured, he shall notify the
said inspector and measurer, whose duty it shall be imme-
diately thereafter to inspect and measure the same, but that
nothing herein contained shall be construed to compel any
person to have his or their lumber or coals measured or in-
spected, but that all persons wishing it shall have it done
by the measurers or inspector appointed; and if any per-
son shall measure lumber or coals in the said town, and
receive pay therefor, without being appointed by the go-
vernor and council, as aforesaid, and contrary to the true
intent and meaning of this act, such person or persons, so
offending, shall forfeit and pay the sum of twenty dollars for
each and every offence, to be recovered in the name of the
burgess and commissioners of the town of Williams-Port,
for the use of the town.

Sec. 5. And be it enacted, That the measurer and pro-
prietor of lumber shall be guided in all respects in regard to
the inspection, measuring and marking the same, by the
same rules and regulations prescribed in the act of assembly,
entitled, An act for the inspection of lumber, passed at
November session eighteen hundred and eleven, chapter
171, and shall be entitled to the same fees for their services
which are allowed by the said act or the supplement there-
to.

Sec. 6. And be it enacted, That the measures or instru-
ments to be used by the inspector or measurer, shall be an-
nually tried and proven, as weights and measures are now
required to be in the several counties of this state.
