CHAP. 124.

of Somerset county to alter and change the public road across
Dames' Quarter Neck near the residence of the late Henry
White, deceased, so that the same shall lead from the point
on the present road where the private road of the said Hen-
ry White, deceased, diverges from it, thence through the

Proviso

thence with a straight line to the side of Dames' Quarter
Neck, lying on the Sound; Provided, that all expenses of
the said new road shall be paid by Alice White; And pro-
vided also, that it shall not be necessary for the levy court
to issue a commission to any person or persons to view and
lay off the said road, but the same shall be viewed by some
member of the levy court, and if they shall, upon his re-
port, receive the said road, it shall be and remain thereaf-
ter a public highway.

CHAP CXXV.

Passed Mar. 7, 1829

A Supplement to an act. entitled, An act to Incorporate the
Village of Port Deposit, in Cecil County.

Section repealed

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, That the sixteenth section of the original law to
which this is a supplement, be and the same is hereby re-
pealed.

Sec. 2. And be it enacted, That from and after the pas-
sage of this law, that if any person or persons shall refuse
or neglect to pay their taxes, fines or forfeitures, charged
against them by virtue of the act to which this is a supple-
ment, it shall and may be lawful for the said commission-
ers to collect the same by execution, in the same manner
that the collector of county charge may collect said coun-
ty charges.

CHAP. CXXVI.

An Act for the Benefit of James H. Mitchett, of Worcester

Authorising gates

to be erected on

road

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, That James H. Mitchell, of Worcester county, be
and he is hereby authorised to erect and keep a gate or gates
across a road laid out and opened by commissioners appoint-
ed by the levy court of said county, and passing through the
farm on which the said James H. Mitchell resides, any law,
usage or custom, to the contrary notwithstanding, upon the
express conditions following: That the said James H. Mitch-
ell, or any other person or persons who may hereafter occu-
py the land and premises whereon such gate or gates have
been erected as aforesaid, shall have said gate or gates hung
on good and sufficient iron hinges, and shall at all times keep
