Army, and for the technical branches and staff corps or de-
partments such other civilians as may be specially qualified
for duty therein.

The number of officers and grades thereof appointed in the
National Guard shall conform to the like number and grades
provided for and authorized by the Statutes of the United
States and regulations of the War Department made pur-
suant thereto for the government of the National Guard of the
United States. The non-commissioned officers required for
and appointed in the staff corps and departments shall con-
form, in number and grades and qualification, to the like num-
ber and grades and qualification, provided for and authorized
by the Statutes of the United States and regulations of the
War Department made pursuant thereto for the government
of the National Guard of the United States, provided, how-
ever, that such non-commissioned officers shall be appointed
and warranted by the Adjutant General of the State upon
the recommendation of the senior officer in each staff corps or
department.

23. All officers shall be appointed and commissioned by
the Governor as follows: Colonels and other field officers of
units composing a brigade upon the recommendation of the
Brigade Commander. All other officers upon the approved
recommendation of the Commanding Officers of the respective
units or Chiefs of their respective Staff Corps or Depart-
ments. A Brigadier General and a Colonel of a regiment at
the time of his appointment must be an officer in the National
Guard of this State of the grade of field officer or have been
in active service in the Army, Marine Corps or National
Guard with higher rank than Captain. A Lieutenant Colonel
or Major of the line at the time of his appointment must
have had active service as an officer for two years in the
National Guard or in the Army or Marine Corps of the
United States.

24. Every officer shall within ten days after his appoint-
ment is tendered him, take and subscribe to the following
oath:

in the National Guard of the United States and of the State
of Maryland, do solemnly swear that I will support and de-
fend the Constitution of the United States and the Constitu-
tion of the State of Maryland, against all enemies, foreign and
