springs, brooks, water streams or watercourses or any other
material which partakes of or is a necessary part of realty, or
for any right of way which they may find necessary for the
conduct of said water and sewerage into, in and out of said
town, or if such owner is under any disability or incapacity to
contract or absent out of the county or unknown, the said
Mayor and Town Council of Kitzmillersville is hereby clothed
with the power of condemnation under the right of eminent
domain as provided in Sections 399 to 404, both inclusive of
Article 23 of the Code of Public General Laws of Maryland,
as fully as if said sections had been herein incorporated; and
their manner of procedure of condemnation for the purposes
of the Act shall in all particulars be the same as is provided
in said Sections 399 to 404, both inclusive, of said Article 23.
The said Mayor and Town Council of Kitzmillersville shall
have full power to fix schedules of rates for furnishing water
and sewerage to private residences and other buildings, and
for all purposes, and the said Mayor and Town Council shall
have full power to collect the same as other taxes are collected,
or in such manner as they may deem most expedient and
proper, and the income thereof shall be applied first for ex-
penses and maintenance and afterwards for the payment of
the interest on said bonds and the principal amount thereof
when and as said bonds shall mature, or be taken up under
the option of the said Mayor and Town Council of Kitz-
millersville.

SECTION 3. And be it further enacted, That the said Mayor
and Town Council of Kitzmillersville are hereby authorized
and empowered to pass all such ordinances as may be neces-
sary for the successful operation of said system of waterworks
and sewerage, by regulating the use and tapping of the same
by the residents of said town, and the interference therewith
by any and all persons, and shall have power to pass all such
ordinances as may be necessary requiring the residents of
said town, or the property owners thereof, to discontinue
the use of all pit or surface closets used in said town, wherein
fecal matter is permitted to accumulate.

SECTION 4. And be it further enacted, That, the title to
said waterworks and sewerage and all land, estates and water
courses, waterways, conduits, pipe, machinery and all other
parts thereto shall when completed or acquired vest in the
Mayor and Town Council of Kitzmillersville. And every per-
