CHAP. 77.

from the city of Baltimore: and whereas, upon a ques-
tion of such moment to the citizens of said county . it is
right and proper that the opinion of the majority should
be distinctly ascertained, for the information of the
Legislature:— Therefore,
|
|
|
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall be the duty of the Sheriff of
Baltimore county, and he is hereby enjoined and re-
quired, under the penalty of five hundred dollars, cur-
rent money, for at least three successive weeks, next
immediately preceding the first Monday of October
next, to give public notice, by advertisement in two
newspapers printed in the city of Baltimore, and by
hand-bills, to he set up, at least three weeks prior to
the said limited day, at the respective places of holding
elections, in the several election districts of said coun-

ty, that a separate pull will be opened by the judges of
and act, in such election district of said county, on said

first Monday of October, for the purpose Of taking the
sense of the people of said county, upon the propriety
of separating said county from the city of Baltimore.

Duty of Judges
of Election to
receive votes
|
SEC. 2. And be it enacted, That it shall be the duty
of the judge or judges of election, who shall qualify
and act in the several election districts of said county,
at the time of holding the next election for Delegates
to represent said county in the next of General Assem-
bly, to receive and dcposite in a separate box, to be
provided by the said Sheriff for that purpose, the bal-
lot of each and every person, legally qualified to vote
in such district, for members of the House of Dele-
gates, who sliall personally appear before him or them,
during the time the polls are actually kept open, and
offer to vote on the said question of proposed separa-

tion; and to cause to be entered in a separate book, to
be provided for that purpose, by the said Sheriff, the
name of each and every voter, who shall actually vote
on said question of proposed separation; and immedi-
ately after ascertaining the result of the votes for Dele-
gates, it shall be the duty of such judge or judges to
open the said ballot-box, and publicly to count the

certify the result, under his hand and seal, or under
their hands and seals, to the Clerk of Baltimore coun-
