GOVERNOR, — In case of vacancy occurring in the of-
fice of, the General Assembly if in ses-
sion, or if in recess, at their next session,
shall proceed to elect by joint ballet of the
two houses, some person, being a qualifi-
ed resident of the gubernatorial district,
from which the, for the said term is to be
taken to be, for the residue of the said

Until such election take place, and the
qualification of the person succeeding, the
secretary of state shall ad interim, be clo-
thed with the executive powers of govern-

In case of vacancy, refusal, death, re-
moval, &c. of the secretary of state, the
president of the senate shall be clothed

with the executive powers of government
And in case of like vacancy in that of-
fice, the speaker of the house of delegates
shall ad interim be clothed with those pow-

The, to be elected in January, 1838
shall serve for one year, and until the

election and qualification of a successor,
At the time and place of holding elec-
tions for delegates for December session,
1838, &c. and in every third year there
