and the same is hereby extended for the term of three
years from the passage of this act.
SEC. 4. And be it enacted, That nothing in the origi-
nal act to which this is a supplement, or in this suppler
ment contained, shall be construed to authorise the
purchase, condemnation or occupation of any lands or
routes necessary to the passage or construction of the
Chesapeake and Ohio Canal, or the Baltimore and Ohio
Rail Road, or any other work previously chartered and
incorporated, or to injure or interfere with the same.

CHAPTER 61.


An act to appoint Commissioners, and to authorise them

to open and lay out Alleys in the Town of New Wind-
sor, in Carroll County.

Passed Feb. 23,
1836.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Moses Shaw, Thomas Smith, and
William Dudderar, be, and they are hereby constituted
and appointed commissioners, and as such are hereby
authorised and empowered to open and lay out back
alleys twelve feet wide, on the north and south side of
the main street, in said town of New Windsor, accord-
ing to the plat of said town, and for the purposes of this
act, are authorised to condemn the property of the per-

sons over whose lands the said alleys may be opened
and located, and shall allow to the proprietors of said
lands a full and fair value or compensation in the shape
of damages for the land that may be condemned as
aforesaid, always taking into consideration the advan-
tages and disadvantages.

SEC. 2. And be it enacted, That the following per-
sons, to wit: Margaret Dodds, Hester Brawner, Catha-.
rine M. Brawner, William Pole, Jesse L. Warfield,
John Zimmerman, Benjamin W. Bennet, Jesse Woods,
Frederick Winters, Catharine Winters, Elijah Bond,
George Earhart, and Isaac Atlee, shall be liable for,
and shall pay the said damages to be ascertained as is
provided in the first section of this act, to the persons
respectively whose lands may be condemned as afore-
said, before any alley shall be opened and made; the
said commissioners to apportion the said damages a-
