CHAP. 36.

discretion, so soon as the aforesaid commissioners shall
have reported to the Levy Court as aforesaid, if in
favor of the same, ta shut up the aid road running from
Driver's cross roads to the intersection of said new
road, at or near the south end of Carter's or White's
lane, any law, usage or custom to the contrary not-
withstanding.


CHAPTER 66.

Pawled Feb. 23,
1837.

A supplement to an act, entitled an act to Incorporated
company to make a turnpike road from such point as
the Somerset and Cumberland Turnpike Company of
Pennsylvania shall fix upon at the Pennsylvania line,
to the public square in the Town of Cumberland, or to
intersect the United States' road, commonly called the
National road, at such point as may be most conve-
nient and practicable.

empowered to
act

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Charles Ogle, of Somerset county,
Pennsylvania, be and he is hereby constituted and ap-
pointed a commissioner in addition to the commission-
ers named in the act to which this is a supplement,
and that a majority of the commissioners named and
appointed in the act to which this is a supplement and
by this act, be, and they are hereby authorised to have,
bold, use, do; exercise and perform all the duties,
rights, powers and privileges which the commissioners
in said act were authorised to have, hold, use, do, ex-
ercise and perform.

Condition to

SEC. 2. And be it enacted, That the said company
be, and are hereby authorised to commence the said
work whenever the sum of ten thousand dollars shall
nave been subscribed in pursuance of the original act
to which this is a supplement

Time extended

SEC. 3. And be it enacted, That the original act to
which this is a supplement, be and the same is hereby
re-enacted and revived, except as in this act is altered
and changed, and that the time limited and provided in
the eighth section of the said original act, for the com-
mencement of the work contemplated in said act, be,
