LAWS OF MARYLAND.

CHAP. 62.

Thereupon

mongst the persons charged with the payment of the
said damages, and upon the payment of the same or a
tender thereof, the said commissioners may proceed to
open and locate the said alleys.

Case of neglect
to pay

SEC. 3. And be it enacted. That if one or more of the
said persons charged with the payment of the said dam-
ages, shall neglect and refuse to pay or tender his por-
tion of the same to the person or persons entitled, and
his portion shall be paid by one or more of the others
charged with the payment of the said darn ages, he or
they so paying shall and may compel the person or per-
sons so neglecting and refusing, by an action or suit in
the county court, or in the district court, or before a
single justice of the peace, according to the amount of
the said damages, to pay the same by way of contribu-
tion.

Compensation

SEC. 4, And be it enacted, That the commissioners
shall be entitled to two dollars a day for each day they
may be necessarily employed in the discharge of the
duties herein imposed upon them, which shall be pay-
able by the same persons in the same manner that the
damages aforesaid are made payable; that the said com-

missioners shall make a certificate and plat of all alleys
by them made, opened and located, and shall file the

same in the clerk's office of Carroll county, to be by
him recorded.


CHAPTER 62.

1837.

An act to appoint Commissioners of the Tax, for Carroll
County.

One for each
Election dis-
trict.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act
it shall be the iluty of the Governor and Council, and
they are hereby required annually to appoint nine of
the best qualified persons, citizens of Carroll county,
one resident of each election district, to be styled the
commissioners of the tax for Carroll county, and the

persons appointed commissioners as aforesaid, shall
out of their own body elect a president, and in case
of the death, resignation, refusal to act, or removal out
of the district of either of the commissioners appointed
