dred and thirty-nine, and to the end of the next session
of the General Assembly thereafter.

CHAP. 59.

CHAPTER 59.


An act to authorise Thomas S. Carter and William F.
Chiltton, of Caroline County, to alter and change a
road therein named.

Passed Feb. 98,
1837.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That from and after the passage of this
act, it shall and may be lawful for Thomas S. Carter
and William F. Chiltton, of Caroline county, to open
a new road on the line dividing part of the said Carter
and Chiltton's lands, commencing on the road leading
from Driver's cross roads to the said Chiltton's saw
mill, and running thence with said divisional line, un-
til it intersects the old road near a school house, at the
south end of Carter's or White's lane.

SEC. 2. And be it enacted, That Edward B. Hardcas-
tle and James Carter, be and they are hereby appoint-
ed commissioners, Whose duty it shall be, on informa-
tion being given by the said Thomas S. Carter and
William F. Chiltton, that the said road is made and
opened, to repair to and inspect the same, and if in
their judgment, they believe it to be a good and perma-
nent road, to report the same to the Levy Court of
said county, whose duty it shall he to receive the said
new road in lien of the one now used.

SEC. 3. And be it enacted, That if the said commis-
sioners, or either of them, should die or refuse to act,
then it shall be the duty of the Levy Court to fill said
vacancy or vacancies; and the commissioners acting

to the sum of two dollars per day for each and every
day they shall be actually engaged in the performance
of the duties imposed upon them by the provisions of
this act, to be paid by the said Thomas S. Carter and
William F. Chiltton.
