CHAP. 276.

supplement, it shall be the duty of the chief justice of
the court before whom said suit, complaint or prosecu-
tion has been removed, to deliver all the papers and
proceedings of the case to a constable of the county, to
be delivered to the chief justice nf the district court to
which said suit, complaint or prosecution, shall have
been ordered for trial.

His duty to de-
liver

SEC. 2. And be it enacted, That it shall be the, duty
of the constable to whom said papers and prcceedings
are sent, to deliver the same without delay to the chief
jutice of the district court to whom the same shall be
directed.

His fee therefor

SEC. 3. And be it enacted, That for said service the
constable shall be entitled to the sum of fifty cents, to
be paid by the party petitioning for said removal.

Restriction re-
pealed

SEC. 4. And be it enacted, That the executive shall
not hereafter be restricted to the list of justices of the

district courts, and every person appointed and com-
missioned a justice of any of said district courts, shall
by virtue of his commission as a district justice, pos-
ess all the powers and authority of a justice of the
peace, in addition to those of a district justice.

SEC. 10. And be it enacted, That the commissions
to the said district justices, shall hereafter be sent by
the executive to the clerks of the several county courts,
3 and it shall be the duty of said clerks to record the
said commissions, sent to them, in proper record books,

for that purpose, and after recording the same, to de-
liver the originals to the justices, or some one of the
justices named in said commissions respectively, upon
application for the same.


CHAPTER 276.

1837.

A further supplement to the act, entitled, an act to In-
corporate the Baltimore and Ohio Sail Road Company.

Authorised to

Be it enacted by the General Assembly of Maryland,
That when in any case the president and directors of
the Baltimore and Ohio Rail Road Company shall be
of the opinion that the construction of a rail road late-
ral to any part of the road or roads of said company,
or in continuation of, or connection with such lateral
