LAWS OF MARYLAND

CHAP. 124

land through which the said road may pass, shall re-
quire the same, or if the said owner or owners be un-
der age, or feme covert, the said commisssioners shall
apply to a justice of the peace of the county wherein

Bequest

the said lands lie, to summon a jury of at least twelve
freeholders, to assess the damages done to the said
lands, which jury shall be sworn, and return their in-
quest in the usual mode now required by law.

Oath required

SEC. 4. And be if enacted, That the said commis-
sioners, before they proceed to act, shall take an oath
or affirmation before some justice of the peace, that they
will without favor, partiality or prejudice assess the
damages sustained by the persons through whose lands
the said road may pass.

Superinten-
dence

SEC. 5. And be if enacted. That after the said road
shall be surveyed and located, the opening thereof shall
be superintended in each county respectively by the
commissioners, or a majority of them, appointed for
said counties.

Account of ex-
penses

SEC. 6. And be it enacted, That the said commis-
sioners, or a majority of them, be, and they are hereby
required to make out upon oath or affirmation, an ac-
count of the expenses of surveying and opening said
road, including an allowance of two dollars per day to
the commissioners for their services, and the levy court
of said counties are hereby authorized and required to
levy the same on the assessable property of said county,
to be collected as other county charges are.

Limitation

SEC. 7. And be it further enacted, That the expenses
of said road shall not exceed, to Anne Arundel county,
including the per diem of the commissioners, the sum
of three hundred and fifty dollars, nor to Montgomery
county, including as aforesaid the sum of one hundred
dollars.

Divorce

Be it enacted by the General Assembly of Maryland,
That Eliza Ann Boyd, of Kent county, be and she is
hereby divorced from her husband James Boyd; and
