JANUARY COURT 1695/6

106 ~  14 January 1695/6 Court convenes; Commissioners present: Francis Jenckins, Thomas Dixon; George Layfield; Thomas Newbold, Samuel Hopkins; Thomas Jones, John King, Arnold Elzey.

106 ~ Court orders Sheriff to summon Grand Jury; following panel is returned: John Lane, Abraham Kyle, Edward Stockdell, Robert Smith, Robert Catlin, Samuel Handy, John Roach Jun., John Townsend, Sen., Daniel Dennahoe, Robert Polke, Abraham Knott, James Givan, Robert Givan, Edward Harper, Thomas Quillain, Francis Martin; take oath, receive their charge and are sent forth.

106 ~  Thomas Hardeman, servant of Arnold Elzey, appears with copy of Court record from 11 January 1686/7 in which it was judged that he was between 12 and 13 years of age; asks for his freedon; Court judges that he has one more year to serve.

106 ~  Petition of Mary Mcgraugh, widow, for Court to ask Governor to dismiss the £10 bond from 1689/90 on her deceased husband for good behavior; states that she has been left with seven small children and is in a deplorable and helpless condition; Court judges her to be an object of charity and instructs Clerk to inform Governor of same.

106 ~  Case against William Noble, Jun. et al; Grand Jury indictment from November Court at Dividing Creek cited William Noble, Walter Tayler, Samuel Marchment, Thomas Philps, John Broughton for not attending Overseer of Highways when duly informed; Noble claims he had been in Accomac and was not informed; Broughton was Constable; Court dismisses charges against Noble and Broughton.

107 ~  Order to issue warrant to Willian Noble, Sen. to answer.

107 ~  Case against Samuel Fluellen, Thomas Farnell, John James, Edward Ross, William Leyton, John Wilson, Thomas Wilson; Grand Jury indicment from November Court at Dividing Creek cites them for stopping up the highway, informer John Meclester; Flewellen presents two affadavits attesting to the good condition of the highway; statement signed by Robert Collier, Peter Doughty, John Furbuss, Stephen Cannon, Patrick Quatermus, John Ellinsworth, Benjamin Lawrence, Elizabeth Wilson, Peter Body, 4 January 1695/6, asserts that the highway to Nanticoke Point is in good condition and has been in use for twenty years; statement signed by James Dashiell and Peter Doubley, 11 January 1695/6, asserts that the highway can be traversed by six horsemen abreast all the way to Nanticoke Point; also states that Samuel Heyden and Hans Lawson, the evidences cited by Maclester, deny making any complaints; attributes the complaint to Meclester’s malice and spite; Court dismisses charges, orders Meclester to pay fees.
