CHAPTER 42.
AN ACT to repeal and re-enact with amendments Section 447,
of Article 16 of the Code of Public Local Laws, of Mary-
land, title "Montgomery County, " sub-title "Roads, " as
contained in Chapter 790. of the Acts of the General As-
sembly of 1912, so as to prohibit obstructions being placed
on any public road and highway within said County and to
provide penalties therefor.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 447, of Article 16, of the Code of Public
Local Laws of Maryland, title "Montgomery County", sub-title
"Roads", as contained in Chapter 790 of the Acts of 1912, be
and the same is hereby repealed and re-enacted with amend-
ments, so as to read as follows:
SEC. 447. Any person who shall recklessly shoot along any
public road or highway, or on the streets of any town or village,
in Montgomery County, thereby causing injury to persons, stock
or vehicles, shall be deemed guilty of a misdemeanor, and upon
conviction thereof, before a justice of the peace, shall at the
discretion of said justice be subject to a fine of not less than
five dollars and costs for each offense; the fine shall be doubled
in every instance if the offense be committed in the night, or on
Sunday; and the offender shall be committed to the County Jail,
until discharged by due process of law. Any person who shall
deposit, place or leave in, or upon any public highway, or on
any of the streets of any town or village in Montgomery County,
any glass, crockery, nails, tacks, tin or iron cuttings, hoops,
wagon tires, or other article or thing, liable to wound or injure
man or beast or cause damage to any vehicle, or to any personal
property, shall be deemed guilty of a misdemeanor, and upon
conviction thereof, before a justice of the peace, shall at the
discretion of said justice, be subject to a fine of not less than ten
dollars, and costs for each offense; and the offender shall be
committed to the County Jail, until such fine and costs are paid,
or until discharged by due process of law.
