annually thereafter on the first Monday in June, three persons
to act as Commissioners of said Town, all of whom shall have
been qualified to vote in a town election in said town for at
least one year next preceding their election.

SEC. 4. And be it enacted. That the Commissioners of said
Town shall annually on the first Monday in May appoint three
persons from among the voters thereof to act as judges of elec-
tion. And the said judges of election shall give at least ten days'
notice, by posting not less than five written or printed notices
in conspicuous places in said town of the time and place at,
which said election shall be held; and the said judges of elec-
tion, before opening the polls, shall make oath or affirmation
before some justice of the peace for Prince George's County,
that they will fairly and impartially act as judges of said elec-
tion; and the said judges shall keep the polls open from three
o'clock P. M. until seven o'clock P. M., and shall record the
names of the voters and after the closing of the polls, shall
count the ballots and announce the result, and make and sign
a certificate thereof to be filed among the records of said
corporation. And in case of any tie vote being cast, so that
no three men shall receive the highest number of votes cast,
the said judges of election shall call another election in not
more than fifteen days, and shall give notice as above provided,
at which election there shall be ©lected such number of com-
missioners, as with those receiving a majority at the regular
election, will fill the board of three commissioners.

SEC. 4. And be it enacted, If any vacancy shall occur by
the death, resignation, removal, or refusal to act of any com-
missioner of said town, the remaining commissioners shall elect
a proper person to fill said vacancy; and all cases of contested
election of said commissioners shall be decided by the judges
of the Circuit Court of Prince George's County; and pending
any contest, and until the Court shall decide who is legally
elected, the commissioners holding the office by virtue of a pre-
vious election shall continue to hold the office until the con-
tested election is decided, and until the successors shall be
legally elected and qualified.

SEC. 5. And be it enacted, That if the citizens of said town
at any time neglect to make an election at the time fixed by
this charter, the power of electing commissioners shall not
cease, but shall continue, and the commissioners for the time
being shall continue in office until the election and qualification
of their successors.
