vided that nothing in this section shall prevent the owners or
the party in possession of any lands in Frederick County from
giving written permission to non-residents to hunt on their
lands in said County.

SEC. 11. And be it enacted, That it shall be unlawful for
any person or persons to shoot, take, capture or kill, or have
in his or their possession in any one day more than eight (8)
rabbits, ten (10) squirrels, ten (10) Jack Snipe, three (3)
pheasants or five (5) woodcocks, and any person violating this
Section shall upon conviction thereof, be fined five dollars
($5. 00) for each and every bird or animal so killed, or taken,
shot or destroyed, in excess of the limits prescribed by this
Section.

SEC. 12. And be it enacted. That the possession by any
person within said County of any of the Birds or Animals
mentioned in Section 9 shall be prima facie evidence that the
same was taken, trapped or shot in said County.

SEC. 13. And be it enacted, That any person or persons
violating the provisions of Section 9 of this article, hereinbe-
fore set forth, shall upon conviction thereof before any Jus-
tice of the Peace of the County aforesaid be fined not less than
ten dollars nor more than fifty dollars, and in default of the
payment of said fine and costs shall be committed to the County
Jail for Frederick County for not less than ten days nor more
than thirty days; one-half of all such fines shall be paid to the
informer, and the other half shall be paid over to the County
Commissioners of Frederick County for the purpose of im-
proving the Public Roads of said County.

SEC. 14. And be it enacted, That no person or persons shall
have the right to hunt with dog or gun, or set traps, steel traps,
snares or loops, for the purpose of taking or capturing any
wild birds or game mentioned in Section 9 hereinbefore set
forth, on any land in Frederick County (except timber lands
not enclosed) without having obtained from the owner or one
of the owners thereof, or the party in possession of said land,
a written permit to hunt or trap on the same, and the person
or persons so hunting or trapping on said land, shall be re-
quired to carry the said written permit with him or them
whilst so hunting. This Section shall not include any unen-
closed timber land. All persons hunting with dog or gun,
or trapping or setting traps as aforesaid shall exhibit such
