778 LAWS OF MARYLAND. [CH. 378

WHEREAS John Edward Hale of Mount Winans, Maryland,
did on or about the 28th day of May, 1915, pay to William P.
Cole, Clerk of the Circuit Court for Baltimore County, the
sum of Four Hundred ($400) Dollars for a retail liquor deal-
ers license of the State of Maryland for twelve (12) months,
accounting to the first day of May, 1916, "to sell spirituous or
fermented liquors by the drink, or in quantities of not more
than a quart, " and did have issued to him by the said Clerk
the said license in accordance with the provisions of the Code
of Public General Laws and Chapter 179 of Acts of the Gen-
eral Assembly of 1908. That of said sum, in accordance with
provisions of the said Acts, one-fourth of the said monies paid
for the said license was paid to the Treasurer of the State of
Maryland and three-fourths thereof was paid to the Board of
County Commissioners of Baltimore County.

AND WHEREAS subsequently thereto the said James W. Shea,
through one, John Tulley, purchased from said John Edward
Hale, the license aforesaid and applied in the regular way to
have the Circuit Court of Baltimore County approve said
transfer, but the said Court on June 14th, 1915, refused to do
so; and

WHEREAS said license has not been used by any of the
parties mentioned herein nor by any other person or persons,
and no sales under it have been made; therefore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the proportionate parts of said license from
the fourteenth day of June, 1915, to the 30th day of April,
1916, be refunded to the said James W. Shea, and the Board
of County Commissioners of Baltimore County are hereby
authorized and directed to refund and pay to the said James
W. Shea, the sum of $262. 50, being the proportionate part
from June 14th, 1915, to April 30th., 1916, of three-fourths of
the money paid for the said license and received by the Board
of County Commissioners of Baltimore County, and that- upon
the warrant of the "Comptroller, the Treasurer of Maryland is
hereby authorized and directed to refund and pay to the said
James W. Shea, the sum of $78. 33, being the proportionate
part from June 14th, 1915, to April 30th, 1916, of one-fourth
of the money paid for the said license and received by the
Treasurer of Maryland.

SEC. 2. And be it further enacted, That this Act shall take
effect on the first day of June, 1916.
