1498 LAWS OF MARYLAND. [CH. 680

Commission is also authorized and empowered to employ and
fix the compensation of such assistants as engineers, clerks,
mechanics and laborers as may be necessary for the carrying
on of the work or works they may undertake under this Act,
or the said Commission may make contracts for the accom-
plishment of any or all of the before mentioned purposes or
parts thereof.

Section 397, All contracts and obligations entered into by
the said Commission or a majority of them, shall be binding
as against the city of Havre de Grace. The Commission, or a
majority of them, shall have the power to issue orders on and
demand payment from the Mayor and City Council of said
city on account of any contract made, work done or material
furnished for any of the purposes for which they are appointed
under and by virtue of this Act. And the said Mayor and
City Council shall, upon the written demand of said Commis-
sion, or a majority of them, forthwith pay for any contract
entered into, work done or material furnished to or by said
Commission for the extension of the outlet of the city sewer,
the providing of land, buildings and equipment for the city
fire department, and the improvements to the streets of said
city out of the money received by the Mayor and City Council
from the sale of the bonds aforesaid, excepting that amount
they are authorized by this Act to use for the payment, of the
debt due the Havre de Grace Water Company.

Section 398. It shall be the duty of the said Commission
appointed by this Act, or their successors, to render an account
to the Mayor and City Council of said city on the first Monday
of each and every month, of -their expenditures, together with
a full account of their proceedings.

Section 399. In the case of the death, resignation or re-
fusal to act of any or either of said Commission, a majority of
the other Commissioners shall have full power to fill such
vacancy; provided, however, said vacancy is filled from the list
of registered voters and taxpayers of said city.

Section 400. That this Act shall not take effect until it
shall have been submitted to a vote of the duly registered
voters of the city of Havre de Grace, and shall have been ap-
proved by a majority of the votes of the said voters cast at an
election, which shall be held on the fourth day of May, in the
year 1908, and conducted, and the result announced in the
same manner as prescribed by the existing Charter of the city
of Havre de Grace.
