1352 LAWS OF MARYLAND. [CH. 667

State of Maryland in favor of William H. Dowell, late Treas-
urer of Calvert County, for the sum of three hundred and
fourteen dollars and seventy-nine cents ($314. 79), the same
being for money erroneously paid by him into the State Treas-
ury as State taxes for the year 1913.

SEC. 2. And be it further enacted, That this Act shall take
effect from the first day of June, 1916.

Approved April 18th, 1916.

CHAPTER 667.

AN ACT to amend Section 140-D of Chapter 156 of the Acts
of the General Assembly of Maryland of 1910, entitled "An
Act for preventing the manufacture or sale of adulterated,
misbranded, poisonous, or deleterious foods, drugs, medi-
cines, water, candies, and liquors and for regulating traffic
therein within the State of Maryland, and to provide fer
the punishment of violations of its provisions, and to appro-
priate an annual sum of money for the purpose of enforcing
this Act by adding certain additional Sections to Article 43,
title 'Health, ' sub-title 'Adulteration of Food and Drink, '
of the Code of Public General Laws of Maryland of 1904,
to be known as 140-A, 140-B, 140-C, 140-D, 140-E, 140-F,
140-G, 140-H, 140-1, 140-J, 140-K, 140-L, 140-M, 140-N
and 140-O, and to repeal Sections 122, 123, 124 and 125
of said Article 43 of the Code of Public General Laws of
Maryland of 1904, and also to repeal Sections 221 and 222
of Article 27 of the Code of Public General Laws of Mary-
land of 1904, title 'Crimes and Punishments, ' sub-title
'Health—Deleterious Candy or Cakes, ' by repealing the
third sub-division thereof and re-enacting the same with
amendments. "

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 140-D of Chapter 156 of the Acts of 1910 be
repealed by striking out the third sub-division defining the mis-
branding of foods, and re-enacting the same so as to read as
follows: Third. If in package form, the quantity of the con-
tents be not plainly and conspicuously marked on the outside
of the package in terms of weight, measure or numerical count;
provided, however, that reasonable variations shall be permitted
and tolerances and also exemptions as to small packages shall
